Serious Copyright Infringement of the EDIUS Software

Case Overview

The High Court of Delhi is currently presiding over a significant copyright infringement case involving unauthorized use of the EDIUS video editing software, owned by Grass Valley. The Court has found that the use of pirated versions of EDIUS constitutes a violation of Grass Valley’s copyright under the Indian Copyright Act, 1957. This infringement is recognized as both a civil wrong and a criminal offence.

Court Orders

In response to the infringement, the High Court of Delhi has issued an ex parte ad-interim injunction in favor of Grass Valley. Additionally, Internet Service Providers (ISPs) have been directed to disclose the identities of users associated with infringing IP addresses.

Identification of Infringing Users

Following the Court’s directive, ISPs have submitted contact details of numerous individuals across India found using cracked versions of EDIUS. These users are now being impleaded as defendants in the ongoing legal proceedings.

Legal Consequences

As affirmed by the High Court of Delhi, unauthorized use of EDIUS software is a breach of copyright law. Grass Valley reserves the right to pursue civil and criminal action against identified users.
